Acceptance of the terms
These terms govern the access to and use of vaultenza.com, operated by Vaultenza SpA, Chilean Tax ID (RUT) 77.951.302-K, with registered address at Av. Apoquindo 4501, floor 14, Las Condes, Santiago. By using the site you confirm that you have read, understood and fully accepted these terms.
Nature of the service
Vaultenza is a real estate crowdlending platform that connects investors with Chilean originators of residential and commercial projects. Vaultenza does not guarantee returns, does not lend money on its own account and does not act as a personal financial adviser.
Eligibility
To invest you must be over 18 years old, hold a valid Chilean RUT or equivalent identification, have a bank account in your name at an institution supervised by the CMF, and pass our Know Your Customer (KYC) and anti-money-laundering processes.
User account
You are responsible for keeping your credentials confidential and for all activity carried out from your account. You must notify us immediately of any unauthorized access at contacto@vaultenza.com.
Investments and risks
Investments made through Vaultenza involve risks, including total loss of capital. Before investing, please read carefully each project fact sheet, the loan contract and the associated risk warning. Published returns are targets and do not constitute a promise of profitability.
Fees
Vaultenza may charge management and success fees, which are clearly disclosed before each investment. Applicable taxes (Income Tax, VAT where applicable) are borne by the investor and are withheld or reported to the SII pursuant to Chilean law.
Intellectual property
All content on the site (brand, logos, texts, images, code, design) is the property of Vaultenza SpA or used under licence. Copying, distributing or modifying such content without prior written authorization is not allowed.
Prohibited conduct
You may not use the site for unlawful purposes, attempt to compromise its security, automate access without permission, impersonate another person, or provide false information in the registration and KYC processes.
Limitation of liability
To the maximum extent permitted by Chilean law, Vaultenza shall not be liable for indirect damages, loss of profit or loss of opportunity arising from the use of the site or from investment decisions taken based on its informational content.
Changes
We may update these terms when legal or service conditions change. We will publish the new version on the site at least fifteen days before it comes into force.
Governing law and jurisdiction
These terms are governed by the laws of the Republic of Chile. Disputes shall be resolved by the ordinary courts of justice based in the city of Santiago, with the parties waiving any other venue or jurisdiction.
